1. Acceptance of Terms

By accessing and using FuelDropper's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of FuelDropper's fuel delivery services, including our website, mobile application, and all related services (collectively, the "Service").

2. Service Description

FuelDropper provides on-demand fuel delivery services to customers in designated service areas. Our services include:

  • Regular fuel delivery to vehicles, equipment, and generators
  • Emergency fuel delivery services
  • Fleet fueling services for commercial customers
  • Scheduled recurring fuel deliveries

All fuel delivery services are subject to availability, weather conditions, safety requirements, and local regulations.

3. Service Areas and Availability

FuelDropper currently serves the Hattiesburg, Mississippi area and surrounding regions. Service availability may vary based on:

  • Geographic location and accessibility
  • Weather conditions and safety considerations
  • Local regulations and permit requirements
  • Fuel supply availability
  • Operational capacity and scheduling

We reserve the right to modify service areas and availability at any time without prior notice.

4. Safety Requirements and Restrictions

Safety is our top priority. By using our services, you agree to comply with all safety requirements:

  • Ensure delivery location is accessible and safe for fuel delivery vehicles
  • Provide accurate vehicle information including fuel type and tank capacity
  • Be present or designate an authorized representative during delivery
  • Ensure no smoking, open flames, or ignition sources within 25 feet of delivery area
  • Comply with all local fire codes and safety regulations
  • Provide safe access to fuel tank or vehicle

We reserve the right to refuse service if safety conditions are not met or if delivery would violate any safety regulations.

5. Environmental Compliance

FuelDropper operates in compliance with all applicable environmental regulations, including EPA requirements. Customers agree to:

  • Report any fuel spills or environmental incidents immediately
  • Comply with local environmental regulations
  • Properly maintain fuel storage equipment
  • Allow access for environmental compliance inspections if required

6. Pricing and Payment

Fuel delivery pricing includes the cost of fuel plus delivery fees. Pricing may vary based on:

  • Current fuel market prices
  • Delivery location and distance
  • Fuel type and quantity
  • Time of delivery (emergency surcharges may apply)
  • Special handling requirements

Payment is due at the time of service unless other arrangements have been made for commercial accounts. We accept major credit cards, debit cards, and approved commercial payment methods.

Emergency deliveries outside normal business hours may incur additional surcharges of up to 50% of the standard delivery fee.

7. Cancellation and Refund Policy

Scheduled deliveries may be cancelled up to 2 hours before the scheduled delivery time without penalty. Cancellations made less than 2 hours before delivery may incur a cancellation fee of $25.

Emergency deliveries cannot be cancelled once our delivery vehicle has been dispatched.

Refunds for fuel delivered are not available unless the fuel delivered does not meet specifications or there was an error in the delivery process.

8. Customer Responsibilities

As a customer, you are responsible for:

  • Providing accurate delivery information and vehicle specifications
  • Ensuring safe and legal access to the delivery location
  • Being present or having an authorized representative available during delivery
  • Maintaining fuel storage equipment in good working condition
  • Complying with all applicable laws and regulations
  • Reporting any issues or concerns immediately
  • Paying for services in accordance with agreed terms

Customers are also responsible for using the service in good faith and not attempting to circumvent system limitations or policies. This includes but is not limited to creating multiple accounts to exceed vehicle limits, providing false information to obtain unauthorized discounts, or manipulating delivery scheduling to avoid fees.

9. Account Abuse and System Gaming

FuelDropper maintains vehicle limits and other system restrictions to ensure fair access to our services and maintain operational efficiency. Attempts to abuse or circumvent these limitations may result in account penalties.

Prohibited activities include but are not limited to:

  • Creating multiple accounts to exceed vehicle registration limits
  • Providing false or misleading information about vehicles, locations, or fuel requirements
  • Manipulating delivery scheduling to avoid emergency fees or surcharges
  • Using the service for unauthorized commercial resale of fuel
  • Attempting to exploit pricing errors or system glitches
  • Sharing account credentials with unauthorized users

Violations of these policies may result in:

  • Warning notices and account monitoring
  • Temporary or permanent account suspension
  • Additional fees to cover administrative costs (up to $100 per violation)
  • Termination of service relationship
  • Legal action for damages or fraudulent activity

FuelDropper reserves the right to investigate suspicious account activity and take appropriate action to protect the integrity of our service.

10. Liability and Insurance

FuelDropper maintains comprehensive commercial insurance including general liability and environmental coverage. However, our liability is limited to the direct cost of fuel delivered and delivery fees paid.

FuelDropper is not liable for:

  • Damage to customer vehicles or equipment due to pre-existing conditions
  • Consequential or indirect damages
  • Delays due to weather, traffic, or circumstances beyond our control
  • Fuel contamination from customer's storage system
  • Damage resulting from customer's failure to follow safety procedures

Customers are encouraged to maintain appropriate insurance coverage for their vehicles and property.

11. Privacy and Data Protection

We collect and use customer information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

We may use customer information to improve our services, process payments, communicate about services, and comply with legal requirements.

12. Intellectual Property

The FuelDropper name, logo, and all related trademarks are the property of FuelDropper. Customers may not use our intellectual property without written permission.

Our website, mobile application, and all content are protected by copyright and other intellectual property laws.

13. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

The arbitration shall take place in Hattiesburg, Mississippi, and shall be governed by Mississippi state law.

Before initiating arbitration, parties agree to attempt resolution through good faith negotiation for a period of 30 days.

14. Force Majeure

FuelDropper shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or supply chain disruptions.

15. Modifications to Terms

FuelDropper reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or mobile application.

Continued use of our services after changes constitutes acceptance of the modified Terms.

16. Termination

Either party may terminate the service relationship at any time. FuelDropper reserves the right to refuse service to any customer who violates these Terms or engages in unsafe practices.

Upon termination, all outstanding payments become immediately due and payable.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
